Mediation FAQs

Is my situation suitable for mediation?

Many situations are suitable for mediation, especially those involving conflicts or disputes where parties are willing to work towards mutually agreeable solutions. Mediation is particularly effective in resolving workplace conflicts, family disputes, and community disagreements. If you’re unsure whether mediation is a fit for your situation, many mediators offer a free initial consultation meeting.

What are the potential outcomes of mediation?

The outcomes of mediation can vary, but typically fall into three categories: full agreement, partial agreement, or no agreement. When a full agreement is reached, parties sign a Memorandum of Understanding (MOU), which outlines the details and scope of the agreement. In workplace situations, this document is often shared with the employer. Occasionally, and where needed, MOUs can be turned into legally binding documents with the help of a lawyer. In partial agreement cases, some issues are resolved, while others may require further negotiation or litigation. If no agreement is reached, parties may proceed to court or another dispute resolution process.

Advantages of bringing in a mediator?

Using an outside mediator offers several advantages. A mediator provides a neutral perspective, facilitating fair and balanced discussions. Mediation is a private process, ensuring sensitive information remains confidential. It is often more cost-effective and quicker than litigation or other formal dispute resolution methods.

How is confidentiality and privacy handled?

Confidentiality and privacy are fundamental to the mediation process. All discussions and disclosures made during mediation are kept private to ensure that sensitive information remains secure. This confidentiality encourages open and honest communication, as parties can speak freely without fear their words will be used against them later. Mediators are bound by ethical standards and legal frameworks that protect the privacy of the mediation process. Additionally, notes or records from the mediation sessions are destroyed after the process concludes.

How long does a mediation take?

The duration of a mediation can vary depending on the complexity and the willingness of the parties to reach an agreement. Generally, straightforward matters can be resolved in a half day. More complex cases may take multiple sessions or days, depending on how successful initial meetings are at reaching agreement. Overall, mediation is usually much quicker than litigation, making it an efficient option for resolving disputes.

What are the costs of mediation and are there additional fees?

The costs of mediation can vary based on several factors, including the mediator’s experience, the complexity of the case, and the location. Typically, mediators charge an hourly rate ranging from $150 to $500. Some mediators charge additional fees for administrative and travel costs. It is important to discuss all potential costs upfront with your mediator beforehand to avoid unexpected expenses. Our fees slide between $225-$350. We are committed to community and offer lower rates and pro bono work to support those in need. Contact us to learn more.
